Change invariant in makeCommitChunkTransactionCommand to uassert

      The invariant in makeCommitChunkTransactionCommand that checks if an FCV operation is not in flight can be invalid since the FCV operation may have started while a migration is in progress. This invariant can be changed to a uassert similarly other parts of this code path.
